Terms of Service

1. Acceptance of Terms
By accessing or using PayQare (the "Service"), operated by Seastream Media Europe SRL ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is intended for business use by companies and their authorized representatives.
2. Description of Service
PayQare is a salary equity analysis and recruitment support platform designed for small and medium-sized enterprises. The Service includes employee data management, pay equity detection, CV analysis powered by artificial intelligence, salary grid recommendations, and data export features. The Service is provided on a subscription basis.
3. Account Registration
To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old and authorized to act on behalf of your organization. You must notify us immediately of any unauthorized use of your account at legal@seastreammedia.com.
4. Subscription and Payment
The Service is offered under paid subscription plans (Starter, Growth, Enterprise) with monthly or annual billing. Prices are displayed in EUR, USD, or GBP depending on your region. All fees are exclusive of applicable taxes. A 14-day free trial is available for new accounts. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
5. Data Ownership and Processing
You retain full ownership of all data you upload or enter into the Service, including employee data, salary information, and CV documents. We process your data solely to provide and improve the Service. We do not sell, share, or otherwise disclose your data to third parties except as described in our Privacy Policy or as required by law. Upon account deletion, your data is retained for 90 days in accordance with our data retention policy, after which it is permanently deleted.
6. AI-Powered Features
Certain features of the Service use artificial intelligence (provided by Anthropic's Claude API) to analyze documents and generate salary recommendations. AI-generated outputs are provided as suggestions only and should not be construed as professional legal, financial, or HR advice. You are responsible for reviewing and validating all AI-generated recommendations before acting on them. We do not guarantee the accuracy, completeness, or suitability of AI-generated content.
7. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) upload or process data you are not authorized to handle; (c) attempt to gain unauthorized access to the Service or its infrastructure; (d) reverse-engineer, decompile, or disassemble any part of the Service; (e) use the Service to discriminate against individuals based on protected characteristics; (f) exceed the usage limits of your subscription plan.
8. Intellectual Property
The Service, including its design, code, algorithms, documentation, and branding, is the property of Seastream Media Europe SRL and is protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes. You may not copy, modify, distribute, or create derivative works based on the Service.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Seastream Media Europe SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from or related to your use of the Service. Our total aggregate liability shall not exceed the amount paid by you in the twelve (12) months preceding the event giving rise to the claim.
10. Service Availability and Modifications
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. Material changes to these Terms will be communicated via email or in-app notification at least 30 days before taking effect.
11. Termination
Either party may terminate the subscription at any time. We may suspend or terminate your account immediately if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Data retention after termination is governed by our data retention policy (90-day grace period).
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Belgium. Any disputes arising from or relating to these Terms shall be submitted to the exclusive jurisdiction of the courts of Brussels, Belgium.
